Mitchell County will not seek U.S. Supreme Court review of steel wheel case

The Mitchell County supervisors announced today that they will not ask the U.S. Supreme Court to review the Iowa Supreme Court’s steel wheel decision.  Last week,  the Iowa Supreme Court unanimously ruled that Mitchell County’s ordinance prohibiting the use of steel wheels violated the First Amendment when applied to members of the Mennonite Church, who equip their tractors with steel cleats as part of their religious practice.  The  Court  expressly declined to decide whether the ordinance violates the Iowa Constitution.
