Iowa Supreme Court Will Issue Opinions in Two Cases Tomorrow

The Iowa Supreme Court will issue decisions in two cases tomorrow (Friday, May 25): Lee v. State and McCormick v. Nikkel & Associates, Inc.

Both cases are on further review from the Iowa Court of Appeals. In Lee, the district court awarded the plaintiff monetary damages and reinstatement of employment after a jury found that the State had violated the self-care provision of the Family and Medical Leave Act. The State had claimed sovereign immunity prevented the court from doing so. The Court of Appeals affirmed the district court’s order. The State seeks further review.

In McCormick, the district court granted summary judgment to the defendant, an electrical subcontractor. The district court found that the defendant did not owe a duty to the plaintiff, an ethanol plant maintenance employee who was electrocuted while working on electrical equipment after the defendant had done work on the job site. The Court of Appeals reversed. The defendant seeks further review.
